We reserve the right to alter these terms and conditions at any time and it is your obligation to check if changes have been made. Your use of this website after changes are made on-line shall constitute acceptance of the new terms and conditions. In these terms and conditions:

  • "you"/"your" means the user of the Web site.

Access to our website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our website without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.

From time to time, we may restrict access to some parts of our website, or our entire website, to users who have registered with us.

Content

In consideration of our agreeing to permit you to use the website to search our database of al things relating to leisure, you agree that you will only use, reproduce and print materials comprising the results of such searches for your own personal, non-commercial purposes. In particular, you must not use the contact details provided by private advertisers of property to contact such advertisers other than in connection with a genuine enquiry relating to the purchase by you of the specific item(s) in question.

The pages within this website may contain technical inaccuracies and typographical errors. The information in these pages may be updated from time to time and may at times be out of date. We accept no responsibility for keeping the information in these pages up to date or liability for any failure to do so.

All content on this website is only for information purposes. The content on this website does not constitute advice and you should not rely on any material on the Website to make (or refrain from making) any decision or take (or refrain from taking) any action.

Credit Card Payment

If you are under 18 or are not using your own credit/debit card to pay for an Advertising Package, you must ask the permission of the credit/debit card holder before entering the payment details. By clicking "Submit" at the point of checkout you are confirming that you have obtained the express prior permission of the credit/debit card holder.

All online payments are taken via RBS WorldPay, RBS's safe and secure payment system.

All card and account details are captured on our secure servers provided by RBS WorldPay and credit card information is used solely for the purpose of payment processing.

Thinkleisure.co.uk retains no record of credit card details.

Our payment processing service supports internationally recognised security checks including:

  • Card Verification Value (CVV2)
  • Address Verification Service (AVS)
  • Cardholder authentication (Verified by Visa and MasterCard SecureCode)

Right to refuse orders

We reserve the right not to fulfil and to cancel orders:

  1. In the event of obvious inaccuracies in items being advertised for sale.
  2. If you are found to be deliberately in breach of terms and conditions or seeking to exploit an 'Advertising Package' in a manor not intended (for example: 'trader' posing as a 'private' seller).
  3. if we are unable to obtain payment authorisation from the issuer of your credit card.
  4. If you have personally or in association with a person or company been previously reported and disqualified from advertising on the thinkleisure.co.uk website.

Delay in delivery and non-delivery

We will not be liable to you for any delay in advertising or non-display of advertising in the following circumstances:

  1. Where the issuer of your payment card refuses to authorise payment to us.
  2. Where delay or failure is due to circumstances beyond our control or the control of our sub-contractors and agents, including but not restricted to electricity power failure, utilities failure, failure of telecommunications links, fire, flood, government act, act of God, legislative constraints, strikes, labour disputes or malicious damage involving employees.
  3. Whereby the advertiser (you) has failed to complete the relevant details correctly.

Cancellations and Refunds

Where an 'initial', 'minimum' or 'fixed' period Advertising Package is agreed, cancellations may be permitted, but in such events, no refund will be allowable until the end of the advertised 'initial', 'minimum' or 'fixed' period has elapsed.

Additionally, any initial 'set-up' charges will also be none refundable under any circumstances.

Should you wish to cancel after the 'initial', 'minimum' or 'fixed period', this will be allowable, and it remains the sole responsibility of the 'advertiser' to close their account thinkleisure.co.uk account and the Shopper Agreement made with RBS WorldPay when the Advertising Package was purchased.

If a thinkleisure.co.uk account is closed by an account holder, it is their sole responsibility to cancel any associated recurring payment Shopper Agreement with their credit card issuer or by logging in to the RBS WorldPay Shopper Management System at http://www.worldpay.com/shopper/admin.

Should the advertiser fail to cancel the associated Shopper Agreement prior to payments being received by thinkleisure.co.uk, payments will be deemed as payable and only at the sole discretion of thinkleisure.co.uk will any such payments be not deemed as payable. In the event of such circumstances, thinkleisure.co.uk may apply any administrational charges they may incur, but such charges are not exceeding the payments received.

All/any credit card refunds will be issued in £GBP sterling. Your credit card company will convert the sterling amount into your local currency and may charge an additional fee for completing the transaction.

Price Information

Prices displayed on thinkleisure.co.uk will prevail at all times in relation to orders placed online, at the time they are placed, except:

  • When a bespoke package or special offer has been requested, agreed and confirmed in writing by thinkleisure.co.uk.

Although we try to ensure that all prices are accurate, errors may on very rare occasion occur. If we discover an error in the price of your order, we will inform you as soon as possible. You will have the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. In such circumstances, we will refund you in full if you cancel the order and have already paid.

Copyright and trademarks

All rights, including copyright, in the content of these web pages and in the photographs of any item displayed on the Website from time to time and all database rights in our database of items, are owned or controlled for these purposes by us.  All trade marks, names, and logos are the proprietary marks of us or of our associated companies. Marks identifying third parties are owned or licensed by those third parties or their associated companies. Nothing in these terms and conditions in any way confers on you any license or right under any trademarks, names or logos.  We are not liable for any failure to perform any of our obligations under these terms and conditions caused by matters beyond our reasonable control.

Liability
